Terms and conditions.

These terms govern access to and use of The Million Token Window at milliontokenwindow.com and milliontokenwindow.ai (the Platform), and the submission, publication and purchase of company listings.

By submitting a listing, approving listing content, placing an order or otherwise using the Platform, you agree to these terms.

1. Business use.

The Platform is intended for companies, sole proprietors and organisations acting for business or professional purposes. By submitting a listing or placing an order, you confirm that you are authorised to act for the relevant organisation.

2. The Platform and tokens.

The Million Token Window publishes company listings in two forms built from one record: a page for people at milliontokenwindow.com, and a machine-readable JSON record at milliontokenwindow.ai.

A token is the unit language models use to process text, and the unit the Platform uses to measure a listing. A token may be a word, part of a word, punctuation or spacing. Counts are made with the tokenizer named on the Platform, cl100k_base, by the method it publishes: the listing’s name and each section of its text are counted, each on its own, and summed. Links, logos, categories, headings, labels and layout are ours and are not counted.

Listings are published to be read by people and by machines. The Platform invites search engines and AI crawlers to read it and says so in its robots.txt. By submitting a listing you accept that its published content may be read, copied, stored, indexed and used, including for the training of AI systems, by third parties we do not control. Section 7 says what we do not promise about any of them.

Tokens are not money, cryptocurrency, securities, investments, ownership rights or transferable assets. They have no cash value and cannot be traded, transferred or redeemed.

The Platform is designed around a maximum published allocation of 1,000,000 listing tokens. This describes the Platform’s planned content capacity. It is not a financial supply, an investment opportunity or a guarantee that every token will be allocated.

3. Free listings and paid listings.

The first 50,000 listing tokens are allocated free of charge to selected companies. A free listing may contain up to 250 tokens and uses only the number of tokens actually published. Free places are subject to review, availability and these terms. A rejected submission does not use a free place and is not charged.

After the free allocation is exhausted, listing space is priced at USD 1 per token purchased unless another price is clearly stated before purchase. Standard paid listing sizes are 250, 500 and 1,000 tokens. Listings above 1,000 tokens may be purchased in additional blocks of 100 tokens. A paid listing reserves the full size purchased; unused space within it remains blank and is not refunded or made available to another company. If fewer than 250 free tokens remain when a listing is approved, the company may take what remains free of charge and purchase the balance up to the 250-token minimum.

A free listing is not credited against a larger paid listing, and a published listing is not enlarged into a paid one.

We may also offer featured placements or other promotional services. Their price, scope, duration and specific conditions will be shown or agreed before an order is confirmed.

Unless expressly agreed otherwise, purchases are one-time and do not renew automatically.

4. Review and editorial discretion.

Every submission is reviewed by a person. Submission, approval of a draft, payment or previous publication does not create an automatic right to be listed or to remain listed.

We may reject, edit, suspend or remove a listing where reasonably necessary because the company, its activities or its content:

• breaches these terms or applicable law;
• is false, misleading, materially inaccurate or cannot reasonably be verified;
• infringes intellectual property or other third-party rights;
• creates a legal, security or reputational risk for the Platform; or
• is inconsistent with our editorial guidelines.

We do not accept pornography or sexual services; violence, trafficking or the promotion of war; unlawful, fraudulent, deceptive or manipulative content; or prompts or instructions intended to manipulate AI systems. We may reject other content that we reasonably consider harmful, exploitative or unsuitable for the Platform.

We will normally give a general reason for rejection or removal where reasonably practicable, but we are not required to disclose confidential review criteria or third-party information.

5. Listing information and approval.

The submitting company is responsible for ensuring that its name, description, claims, website, logo, location and other information are accurate, lawful and properly authorised.

We may prepare or edit a draft using information supplied by the company or available from its official public sources. Publication following the company’s approval does not transfer responsibility for the accuracy or legality of that information to us.

The listing text, its token count and the hosted logo are frozen when the company approves the listing. Listings cannot ordinarily be edited, topped up or extended after publication. We may correct an error or remove content where necessary to comply with law, protect third-party rights or address a material factual or security issue, but we are not required to provide routine updates.

The category is assigned by us from a closed list. Map placement is a location agreed with the company at review — its head office, its registered address or another place it chooses — and verified by us as genuinely the company’s. Position on the map is not for sale. Categories, map positions and the presentation of listings may change as the Platform develops.

6. Rights to submitted material.

The company retains ownership of the material it submits. It grants Baudenbacher Communications a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, adapt, publish and promote that material as reasonably necessary to create, operate and publicise the listing and the Platform.

This includes use of the company name, logo and listing extracts in Platform pages, maps, directories, social media posts and promotional material. The company confirms that it has the rights and permissions needed to grant this licence.

The licence ends when the listing is removed, except for material already included in archived records, completed campaigns, legal records or social media posts that cannot reasonably be withdrawn. The Platform’s own name, design, software, text and branding remain the property of Baudenbacher Communications or its licensors.

7. No endorsement and no promised outcome.

A listing does not mean that we endorse, certify or recommend the company, its products or its services.

We sell a place in the Platform and nothing else. We make no promise about what any AI system, search engine or other third party does with a listing, and we guarantee no ranking, position, traffic, impressions, clicks, leads, sales, revenue or other commercial result. Those systems operate independently and may change how they access, interpret or present information at any time.

We do not provide advertising-style performance reporting, audience tracking or visibility metrics to any listed company. We may conduct and publish research into how selected AI systems represent publicly available company information; such research is editorial, is not a service to any listed company, and is not a promise about any listing.

8. Listing duration and Platform changes.

Listings are sold as permanent places with no scheduled expiry, renewal fee, rotation or later bidding. In these terms, permanent means that the listing is intended to remain published for as long as the Platform operates and continues to support that listing type. It is not a guarantee that the Platform will operate forever or that publication can never end under these terms.

We may maintain, redesign, reorganise, suspend or discontinue parts of the Platform. This may change a listing’s appearance, category, map position or placement. Where reasonably practicable, we will notify affected paying customers before a material discontinuation.

9. Prices, payment and refunds.

Applicable prices, currencies and taxes will be disclosed before an order is confirmed. Customers must provide accurate billing and tax information. Payments may be processed by third-party providers under their own terms and privacy notices.

Paid orders are generally final once publication work has begun. Unused space within a purchased listing size is not refundable. If we reject a paid listing before publication, or cannot provide a paid service for reasons not caused by the customer, we will offer an appropriate remedy, such as correction, a replacement service or a refund of the affected amount. This does not limit rights that cannot lawfully be excluded.

10. Acceptable use and security.

You must not misuse the Platform, interfere with its operation, introduce malicious code, attempt unauthorised access, impersonate another person or organisation, manipulate a promotion, submit content without authority, or use the Platform for unlawful purposes.

We may restrict access or take reasonable protective action where fraud, abuse, a security risk or a material breach of these terms is suspected.

11. Third-party links and availability.

Listings link to third-party websites. We do not control and are not responsible for their content, security, availability, products, services or privacy practices.

We aim to keep the Platform available, but do not guarantee uninterrupted or error-free operation. Availability may be affected by maintenance, technical failures, cyber incidents, third-party services or events outside our reasonable control.

12. Liability.

Nothing in these terms excludes or limits liability where doing so is prohibited by law, including liability for wilful misconduct or gross negligence.

To the extent permitted by law, Baudenbacher Communications is not liable for indirect or consequential loss, or for loss of profit, revenue, data, business opportunity or reputation, arising from use of the Platform, reliance on listing content, third-party services, Platform interruption, or the performance or non-performance of a listing.

Our aggregate liability arising from a paid service is limited, to the extent permitted by law, to the amount paid for the service giving rise to the claim.

13. Privacy.

We process personal data in accordance with applicable data-protection law and our privacy policy, which explains what data we hold, why, whom we share it with and the rights available to individuals.

14. Changes to these terms.

We may update these terms to reflect changes to the Platform, our services or applicable law. The current version and its date are published on this page. Material changes affecting an existing paid order will not apply retroactively unless required by law or agreed with the customer.

15. Governing law and jurisdiction.

These terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

To the extent legally permitted, the courts responsible for Würenlos, Canton of Aargau, Switzerland have exclusive jurisdiction. Mandatory legal rights and mandatory places of jurisdiction remain unaffected.

If any provision of these terms is invalid or unenforceable, the remaining provisions remain in effect. These terms, together with the privacy policy and any confirmed order-specific terms, form the agreement relating to the relevant use or service.
